国际劳工标准、国际贸易与我国劳工标准

摘    要:从国际劳工标准、WTO社会条款到企业社会责任标准,再到SA8000,它们有着共同的特点、共同的作用和共同的推动力量,是国际核心劳工公约逐步与国际贸易挂钩的不断变形.国际劳工标准通过国际组织以及发达国家通过地区贸易协定和贸易优惠条款与国际贸易挂钩的过程,反映出国际劳工标准与发达国家密切的利益关系.因此,本文认为我国劳工标准具有双重含义,我国劳工标准与国际核心劳工公约关系实质上是发达国家和我国基于经济利益和政治冲突的一种挑战和应对关系,国际劳工标准并不可能从根本上解决我国劳工标准问题.

Abstract:From International Labor Standards to WTO social clauses, to corporation social responsibility, and to SA8000, they have common characteristics, functions and promoting power, implying that International Labor Standards is combining with international trade. Since International Labor Standards means great economic interests to developed countries, they made great efforts to link it up with international trade. Thus, this article insists that Chinese Labor Standards has two aspects meanings and that there is a challenging and countermeasure relation between International Labor Standards and Chinese Labor Standards, and that International Labor Standards isnt the method of tackling with the problems of Chinese Labor Standards.
