| 摘 要： | 如何合理使用共有部分是区分所有建筑物的核心问题之一.而合理使用共有部分的理论前提在于应科学界定区分所有建筑物共有部分的概念,并充分认识该部分的法律性质;其实践基础在于应明确共有部分之范围,其核心内容为共有部分各类使用人的权利与义务,其保障机制是严格各类使用人的法律责任.

| Abstract: | How to legitimately apply the mutual section is a one of the key problems of the apartment house. The theoretical precondition to legitimately apply the mutual section lies in giving a scientific definition of the concept of the mutual section and understanding of their legal nature. The practicalbasis lies in crystallizing their extension. The key content is the right and liability of all kind of users. The secure mechanism is the legal obligation of all kind of users. |
