由“药家鑫案”引发的关于“媒介审判”的思考

媒介是信息、情绪的放大器,在当下的社会环境下,媒介一方面发挥着社会公器的作用,对社会生活进行监督,维护社会各个“零部件”的正常高效运转.而在另一方面,媒介强有力的“发声”功能一旦被滥用,就很容易披着“监督”的外衣从社会公器转为凶器,介入司法程序对其进行干预,对新闻当事人造成伤害.尤其是在新媒体蓬勃发展的今天,新技术、新平台使媒介的优势与弊端都得到了放大.“媒介审判”和“媒介监督”虽然只有两字之差,但前者是对司法独立的干预,而后者是对公民知情权的保障,是媒介职能之一,“媒介审判”与“媒介监督”存在着本质的区别.由2010年“药家鑫案”而引发的“媒介审判”的诸多反思,对于媒介功能的思考才刚刚开始,人们对于“媒介审判”的认识在随后一系列相似事件中一点点的加深.“媒介审判”带来的暴力杀伤力强、影响面广令人深思.
