| 摘 要： | 比例原则是现代公法学中的“帝王条款”,比例原则应贯穿于看守所管理的整个过程,针对目前看守所管理中存在的有违比例原则的现象,建立看守所管理的分级管理和处遏制度是十分必要的,本文试图从比例原则的角度探讨看守所管理改革的若干思路.

| Abstract: | Proportion principle is ＂king clause＂ in the modem public law, and proportionality should berun through the whole process of jail management. Aiming at the present situation of jail management which is against the phenomenon of proportionality, it is necessary to set up the classification management and traitement system in the detention center. From the Angle of the proportion principle, this article tries to discuss solution to jail management. |
