| 摘 要： | 优先权为一种法定担保物权,可分为一般优先权、特别优先权。优先权具有法定性、物上代位性、无须以占有或登记进行公示、从属性及不可分性等特点。我国民法应当确立优先权制度。

| Abstract: | As a kind of legal real right guaranteed,priority can be divided into two categories: general priority and special priority.Priority is a kind of legal,subordinate and undividable right;it has the characteristic of subrogate of real right,and it need not be public summoned through possession or registration.The author holds the view that we should establish the system of priority in our country. |
