| 摘 要： | 著作权法律制度是一种分配围绕作品所产生的各方权益的利益平衡机制,其中著作权人的垄断利益与社会公众利益之间的平衡是著作权法利益平衡机制的立足点,其体现了著作权法利益平衡机制之精髓。在当代各国的著作权立法和著作权国际公约中,利益平衡始终是永恒的主题。作为著作权法的价值目标和理论基石,利益平衡机制的建立对著作权法的发展具有深远意义。

| Abstract: | The system of copyright law is the mechanism of balance of interest that distributes the interest around works.The balance of interest between the copyright owners and the public is the foothold point of the mechanism of balance of interest.In the copyright law of each country and the international convention on copyright,balance of interest is the eternal subject.As the value target and theoretical foundation of copyright law,the establishment of this mechanism has far-reaching meaning for the development of copyright law. |
