| 摘 要： | 无过失责任是侵权行为法的一种特殊侵权责任，理论上和实践中均存在着对无过失责任的误解和偏见。其实无过失责任有相对无过失责任与绝对无过失责任之分。相对无过失责任是一种比例责任。我国立法中的无过失责任多是相对无过失责任。

| Abstract: | No - fault liability is a special hability of the torts, there are some misapprehension and preconception in theory and in practice. This thesis thinks that no - fault liability can be divided into the absolute no - fault hability and the relative no - fault liability. The relative no - fault liability is a sort of the proportional liability. Most of the no - fault liability in the positive law of our country is relative no - fault liability. |
