对网络作品著作权的侵权与保护的几点认识

网络作品著作权保护问题随着近年来的数起侵权案的审理而现实地摆在我们面前，网络作品属于《著作权法》保护之列，网络这种新兴媒体有其特殊性，如果一律按现行《著作权法》对其侵权行为进行调整，将对正处于发展中的网络媒体产生不利影响。最高人民法院制定并颁布的《最高人民法院关于审理涉及计算机网络著作权纠纷案件适用法律若干问题的解释》，为解决网络作品侵权案件提供了法律依据。文中将从网络作品著作权的客体与主体，网络作品著作权的三种侵权行为类型，网络作品著作权案件的特殊问题以及加强网络作品著作权保护应注意的问题等几个方面谈几点认识，以期为司法实践提供帮助。

Some Opinions on Network Copyright lnfringement and Network Copyright Protection

The cognizance of increasing infringement cases of copyringhts in recent years suggests that network copyright protection presents itself as an unavoidable fact. Network copyright falls within the protection of Copyright Law. Net, as a newly developed medium, shows its features. Adjustment of any infringement cases according to Copyright Law in cur- rent effect will yield an unfavorable effect on developing net medium. The Supreme People's Court's Interpretation of Several Matters Related to the Law Applicable to Cognizance of Disputing Cases Involving Computer Newtwork Copyright enacted and promulgated by the Supreme People's Court provides legal basis for dealing with network copyright infringement. The paper offer some opinions on several questions, such as the subject and object of network copyright, the three kinds of network copyright infringement, typical matters related to network copyright infringement cases and attentions paid to strengthening the protection of network copyright. The paper is aimed at offering help for judicial practices.
