论发展权的国际贸易法救济

随着国际社会对发展权的逐渐关注,发展权的概念逐渐从“应然人权”发展到了“法定人权”和“实然人权”。国际贸易法上涉及发展权实现的主要有“特殊和差别待遇”条款和“反向特殊和差别待遇”条款。我们应从促进“特殊和差别待遇条款”的完善、加大对发展中国家优惠的可行性和幅度、给予受惠国一定程度的发言权等方面来完善发展权的国际贸易法救济。

With international increasing concern over the development right, the concept of development right changes from ＂possible human right＂ to ＂legal human right＂ and then to real human right＂. Within the international trade law, the realization of development right is mainly shown by ＂Special and Differential Treatment Provision＂. We should perfect international trade law＇ s relief of development right by perfecting the ＂Special and Differential Treatment Provision＂, increasing the favorable treatment to developing countries and giving beneficiary country certain right to speak.
