论法律与道德的冲突及其协调

本文认为，在当今的社会转型期法律与道德的冲突会产生严重的社会问题：一方面，使道德未能“合法化”而陷入危机；另一方面，使“有法不依”的现象不再个别。社会评价的相对合理性是法律与道德发生冲突的根本原因；而法律与道德的差异性和法律自身的局限性是两者冲突的具体原因。只有通过法律与道德的互动耦合，在立法、执法、司法等各个环节上进行系统整合，才能保证人们行为的有序和社会的稳定。

On the Conflict and Coordination Between Law and Morality

The author of this paper holds that the conflict between law and morality at the turning moment of the present society will bring serious social problems. On one hand, it leads morality into crisis without it's being legalized; on the other hand, it causes phenomena of not abiding by law. In fact, the relative justifi- cation of social appraisal is the basic cause of this conflict, while the disparity between law and morality and the limitation of the law itself are the specific causes of this conflict. Therefore, only through the dynamic coordination of law and morality and the systematic adjustment of different links such as legislation, law en- forcement, administration of justice and etc. can the order and stability of our society be guaranteed.
