对图书馆合理使用制度思考

我国著作权法对图书馆适用合理使用的规定比较模糊,人们对合理使用的认识存在许多误区,导致图书馆存在大量非合理使用的现象。网络环境下图书馆适用合理使用制度要服从科学发展观,在法律上应明确图书馆合理使用的范围,合理使用规则的制定必须适应技术发展的要求,图书馆争取合理使用的权利也应当适度。

On Fair Use in Library

Because of the ill-defined copyright law, some people have misunderstanding of about library fair use, which leads to a lot of non-fair use in library. This paper holds that under the network context, the library fair use shall be in line with scientific development concept. The law shall define the scope of fair use and the designing of the rules of fair use shall meet the needs of scientific development. On the other hand there shall be lenient rules on the libraries' right of fair use.
