从“接脚夫”的习俗谈善良风俗的认定——由厦门同安区一则审判案例谈起

善良风俗是我国民法中的一项基本原则，但对子如何认定善良风俗则在司法实践中并没有统一的标准，由各地具体掌握。“接脚夫”习俗是中国农村一项古老的传统习惯，廷传至今在许多地方仍然盛行，一些地方法院将其作为善良风俗予以认定，确定相应的权利义务关系，但其是否“善良”有待商榷，对善良风俗的认定应符合社会星念、法治精神，对一些明显带有封建残余的旧习惯应废除，不应再作为审判依据。

On the Determination of Good Social Custom: A Case Study of "Jiejiaofu" Custom

Good social custom is one of the basic principle in China＇s Civil Law but there is no unified standards in the judicial practice by which such custom is determined. ＂Jiejiaofu＂ as an ancient tradition in China＇s rural area is still quite popular in some places. Some local courts have taken this custom as good custom to identify the rights and obligations. However, in deciding whether it is good or not, recognizing such custom and selecting local judges, the social ideas and legal principles shall be considered. Those outdated feudal customs shall cease to be used as the guidelines in trying cases.
