| 摘 要： | 本文针对我国财产继承制度中存在的不利于保护债权人合法利益的问题进行了较深刻的分析,指出我国应当改无条件的有限责任继承为有条件的限定继承制度,继承违反有限责任继承的条件,即应对被继承人的债务负无限责任。同时还应赋予债权人遗产分立请求权,使债权人能够主动采取法律措施保护自己的合法权益。

How to Protect Creditor's Benefits in Property Inheritance |

| Abstract: | This paper thoroughly analyzes the issues that are unfavorable for the protection of creditor's benefits in China's property inheritance system. It points out that China shall change its unconditioned limited - liability inheritance to conditioned restricted inheritance and the inheritor shall bear unlimited liability for the decedent's debts. At the same time, the creditor shall be granted the right of claim for the division of the legacy so that he can resort to legal measures to protect his own benefits. |
