| 摘 要： | 数字化技术的进步和网络时代的到来,给传统的著作权法带来了严峻的挑战。在网络环境下,如何保护著作权人的合法权利?信息网络传播权应运而生。在保护著作权人权利的同时,又如何能让公众享受到高科技所带来的现代文明,充分发挥计算机网络技术在信息传播上的优势?依据著作权法的立法宗旨,提出了信息网络传播权保护条例的制定应基于保护和限制两个原则。

| Abstract: | Digital technology and internet bring challenges to traditional law of the author's rights.In internet environment,how to protect the author's legal rights,the right of spreading on internet comes out.While we are protecting the author's rights,how should we let the public share modern civilization created by modern science and technology and develop the advantage of internet in spreading?According to the purpose of the law of the author's rights,the paper puts forward two principles of protecting and limiting on which the right of spreading on internet should be based. |
