汇编作品著作权归属与编辑的合理注意义务

汇编作品的著作权归汇编人享有，但只有当汇编作品在内容的选择、编排的体例上具有独创性时，汇编人才享有著作权。同时，汇编人在行使其著作权时不得侵害原著作权人的权利。在出版汇编作品时，编辑出版者应审查作品的来源，并结合作品的内容、来源等确认作品的正确署名，还须与汇编者签订图书出版合同，且需含有关于侵权归责的专门条款，同时，必须审查原作者给汇编人的“许可使用授权书”，即取得双重授权。
