卡拉OK版权收费问题的思考

卡拉OK版权收费问题成为当前社会各界关注的焦点,也是各媒体谈论的热点。文化部和国家版权局先后推出了各自的收费方案,但方案都遭到了各界的质疑尤其是全国各娱乐行业协会的反对。从版权法的角度提出卡拉OK版权收费的主体应是版权局监管下的中国音像著作权集体管理协会,该主体的收费方案应依照《著作权集体管理的条例》的规定,加强版权局与文化部的协作,参照文化部推出的比较准确计费的服务系统,制定出更为细致、合理、可行、可信的收费标准,对卡拉OK经营者实行收费,大力推进和完善我国卡拉OK的版权保护工作,保证我国卡拉OK产业朝规范化、法制化的方向发展。

At present,the charge of karaoke copyright is the social focus.Both China Culture Department and China Copyright Bureau carried out their own charging scheme,which were opposed by amusement association.According to the law of copyright,the charging subject should be China Audiovisual Copyright Collective Managing Association,Whose charging scheme is based on the Regulations of Copyright Collective Management.It can strengthen the cooperation between China Culture Department and China Copyright Bureau,based on an exact valuation system of China Culture Department,making a more detailed,reasonable,credible charging scheme.The protection of karaoke copyright in China will be more perfect.The karaoke industry will be more normal and legal.
