温岭市行业工资集体协商的性质与制度机制研究

摘    要:劳工的群体性事件在我国已初见端倪。集体劳动关系的产生是由于劳资双方地位极端不平衡所致,是法律赋予劳动者通过集体的力量来改变个体弱者地位的有效手段,但其合法性的认可经过了一个较长的历史阶段。工会是代表工人行使集体谈判权的组织,集体合同体现的是工人的"集体意志"与雇主之间的合意。温岭市在工资集体协商方面所形成了三方协商机制、恳谈机制、合意机制、生效机制、监督机制等制度机制,这些机制有效推动了集体谈判的顺利进行。总体看来,政治民主是温岭市开展劳资集体协商的基础,建立行业或区域工会组织是集体协商谈判的组织保障,政府的主导机制和职企博弈机制是协商机制建设的重要环节。

Study on Nature and System Mechanism of Wenling’s Collective Consultation of Industrial Wages

Abstract:Laborers’ mass events have existed in China for a certain long time.The existence of collective labor relations was caused by the extremely imbalance between employers and employees,and is an effective tool granted by laws to labors in developing individual labor’s weak status through collective efforts.Unfortunately,the approval of the relations’ legitimacy has experienced a certain long period.Trade union on behalf of labors exercises the collective negotiation right.Collective contract reflects common agreements between labors’ "collective will" and employers’ contemplation.In Wenling,systems and mechanisms(tripartite consultative mechanism,earnestly talk mechanism,consensus mechanism,effective mechanism,supervision system,and other practicable systems) of wage’s collective consultation have effectively promoted collective negotiations.In general,political democracy is the foundation of developing collective consultation between labors and employers in Wenling,establishment of industrial and/or regional trade unions is the organizational guarantee of collective consultation and negotiation,governments’ guiding system and game mechanism between labors and employers are the important link in construction of consultation mechanism.
