民法视角下的集体土地所有权主体制度改革

集体土地所有权制度是否科学合理，不仅关系到农村经济的全面发展，而且对整个国民经济都具有举足轻重的作用。该制度最关键的是集体土地所有权主体问题。目前我国集体土地所有权主体制度存在性质不明、主体多级性、行使主体不健全等弊端，使得集体土地所有权得不到有效实现，影响了农村经济的持续稳定发展，所以必须对集体土地所有权主体制度进行改造完善，用“集体法人”代替抽象的“农民集体”土地所有权主体，并参照公司法人建立相关的组织机构。

The System Reform of the Body of Collective Land Ownership from View of Civil Law

Rural collective land ownership, as the core of rural land system, not only has a bearing on the development of rural economy, but also plays a vital role in the national economy. The pivotal issue of this system is the main body of collective land ownership. Nowadays, the disadvantages existing in rural collective land ownership in China block up the way of carrying out the collective land ownership effectively, and have negative impact on the sustained and steady development of rural economy. Hence, it is necessary to take action on the improvement and reconstruction of rural collective land ownership. The reform and improvement on the main body of rural collective land ownership should consider the status quo of China＇ s legislation, and in the light of the corporate organizational structure.
