我国政府公共服务外包存在的问题及其法律规制

政府公共服务外包作为促进公共服务供给多元化的一项制度改革,被西方国家广泛采用,然而我国由于制度环境尚未完全形成,政府在实施服务外包的过程中存在着公共服务界定不清、非营利组织发展遭困,政府监管和服务意识缺失、程序不规范等问题,甚至引发权力寻租、腐败、损害公众利益等风险.为此,必须通过法律规制,明晰公共服务外包的范围、界定政府、非营利组织和社会的责任边界,以保障公共服务外包的良性运作与推广.
