对在我国产品责任中设立惩罚性赔偿制度的思考

惩罚性赔偿制度作为一种基本制度已被英美法系国家尤其是美国广泛适用,我国目前在产品责任法中采取的是传统的补偿性损害赔偿原则,随着社会的发展,该原则在产品责任法上受到了挑战和质疑,日益暴露出其固有的缺陷。阐述了惩罚性赔偿原则设置的必要性,提出我国的产品责任法应仿效英美法系立法,建立惩罚性损害赔偿。

On Establishing the Punitive Compensation System in Product Responsibility

dPunitive damages system as a basic system was common applicable to common law countries,especially the United States.China s current product liability law is a traditional principle of compensatory damages.With the development of society,the principle has been challenged and questioned on the product liability law,and increasingly exposed the inherent flaws.After we described the necessity of the principle of punitive damages,it proposed China s product liability law should follow the Anglo-American legal system to establish punitive damages.
