| 摘 要： | 驰名商标是指在一个国家被有关商品(服务)的生产(服务)者、销售者及消费者所知晓的具有较高声誉的商标.驰名商标对于我国实施名牌战略具有重要意义.我国商标法应在以下方面给予驰名商标特殊保护:一、增加保护驰名商标的条款.二、对未注册驰名商标给予保护.三、增加保护驰名商标网上域名的条款.四、增加禁止“商标淡化“和“商标反向假冒“的条款.从而使我国对驰名商标的保护达到国际公约要求水平.

| Abstract: | Wellknown marks refer to the marks in a country enjoying higher reputation given by the producers(servers),salesmen and consumers concerned.Wellknown marks have important significance for our country to implement the strategy of famous trade marks.Trade mark laws of our country should give famous marks special legal protection by adding special items. 1. to protect wellknown marks 2. to protect the unregistered wellknown marks 3. to protect the address name of wellknown marks 4. to ban `Marks ignorance' and `Counter-direction' imitation So as to accord our protection of the wellknown marks with the demand of international conventions. |
