论数字图书馆建设中著作权的权利限制

分析了网络环境下我国数字图书馆建设中所面临的著作权权利限制问题。著作权权利限制的合理使用、法定许可在数字图书馆已不适用,从世界范围版权保护的立法趋势来看,数字图书馆享受合理使用的特权不是在扩大而是在缩小。通过著作权集体管理组织获得版权授权是解决数字图书馆著作权问题的较好途径。

The Right Limitation of the Copyright in the Construction of the Digital Library

This paper analyzes on the problem of the right limitation of the copyright in the construction of our country's digital library under the network environment. The rational use and legal permission of the right limitation of the copyright is not applicable in the digital library, from the legislation trend of the copyright protection in the world, the privilege of the digital library in enjoying the rational use isn't enlarged but is reduced. Obtaining the copyright authority through the collective management organization of the copyright is a better way for solving the copyright problem of the digital library.
