试论火灾证据的采信利用

近年来,因火灾事故诱发申请重新认定和上访诉讼的案件逐年增多,火灾事故原因、责任认定和损失核定逐渐成为火灾事故纠纷和诉讼的依据及争执的焦点。在火灾调查过程中,为查清火灾原因、明确责任,应该充分考虑证据的关联性和合法性,及时、全面、细致、合法地搜集证据,并对搜集到的证据进行审查、验证,确保其真实性和完备性。

Discussion on Adoption of Fire Evidence Information

Recent years,the cause,duty verification and loss check of the fire accident has become the focus of basis and dispute of the accident,as the case of application for repeat verification and request for higher authorities court is increasing year by year.Therefor we should consider evidential relevance and legality comprehensively to investigate the cause and definit duty in fire accident.Foremore we should collect witness timely,comprehensively,carefully,legally and ensure it reality and maturity through checking up and verification.
