对检察长列席审判委员会之合理性质疑的回应

检察长列席审判委员会制度,已成为近年来司法改革的一个热点,作为热点的东西,争议自然在所难免。但是理论争议,特别是关于合理性的分析,由于受到立场的捆绑,往往容易失之于客观。检察长列席审判委员会制度,不是说与其他制度或原则的价值取向没有任何抵牾,但问题远没有那么多,也远没有那么严重。文章试从分析有关该制度的批判入手,以一种反批判的方式,探析和检视该制度的合理性。

Response to the Doubt about the Rationality in Procurator-general’s Attending the Judicial Committee

Summary： The system of the procurator-general’s attending the judicial committee has become a hot topic in recent years’judicial reform.So some controversies over it are inevitable.However,theoretical arguments,especially about the analysis of rationality,tend to be subjective due to the influence of one’s position.In fact,there are some conflicts between this system and other systems or principles,but there are far fewer problems or they are far less serious.Starting from analyzing the criticism about this system,the author of this paper will analyze and review the rationality of the sys-tem in a way of anti-criticism.
