独立学院的宪法学分析

独立学院制度是在我国教育实行产业化的背景下产生的具有中国特色的新鲜事物。由于其地位的特殊性,因而在运作体制方面仍然存在着许多亟待完善的地方。从公民受教育平等权出发,独立学院的办学目的、招生形式、收费方式均与宪法规定有冲突之处,既不符合教育目的,也无法保证受教育权的平等实现。

Constitutional Analysis of Independent Colleges

The independent -college system is a new position with Chinese characteristics in the industrialization of our education background. With its particularity, there are still much to be improved in practice. This article mainly raises question from the aims of the independence - college and the way of charging fees, and analyses it by using the basic theory in Constitution, so that this system will be better.
