| 摘 要： | 大学生诉高校不当处分案不断涌现,这反映了高校学生处分权与学生受教育权的冲突在加剧。为减少高校学生处分权与学生受教育权之间的冲突,使两者达到平衡状态,应从立法、司法以及程序等方面规范、制约高校学生处分权,完善教育立法、明确受教育权的可诉性等方面保障、拓展受教育权。

| Abstract: | The increasing cases of students＇ charging the universities with improper punishment show that the conflict between the universities＇ disposition right and the students＇ education right is intensified.In order to lessen the conflict and keep the balance,the universities＇ disposition right should be restrained and regulated through legislation,jurisdiction and procedures,while the students＇ education right should be guaranteed by perfecting education legislation and specifying the actionability of education right. |
