论隐私权的法律保护

隐私权是生命健康权、姓名权、肖像权、名誉权等人格权体系中较晚出现的一种。我国法律没有把隐私权确立为一项独立的、主要的人格权,只是借助司法觖释并通过保护名誉权的方式以维护公序良俗的隐私权是不完备、不周密的。我们应该借鉴两大法系主要国家的相关立法经验,在宪法、民法典中确认隐私权为公民的一项独立的人格权,对公民隐私权的保护形成以宪法为核心,以民法典为重点,以刑法、行政法等其它法律法规为辅助的直接保护。本文从隐私及隐私权的基本概念入手,在分析国外隐私权的相关立法经验基础上,结合我国现行立法,指出我国隐私权法律保护的缺陷并提出完善我国隐私权的法律保护建议。

On Legal Protection of the Right to Privacy

The right of privacy is the one appearing relatively late in the right system of personality, such as life and health right, right of the name, portrait right, reputation right,etc..Our country has not established the law for the right of privacy as an independent, main personality right. It is neither complete,nor therough maintain the right of privacy of good public custom through protecting the right of the reputation and unsatisfied judicul explauation.Learning the relevant legislative experience of the main country we should use two fundamental laws and principles for reference,confirm in the constitution, the people's code that the right of privacy is an independent personality right of the citizen's,form the core of regarding constitution as to the protection of citizen's right of privacy, regard codes of the people as the focal point,regard other laws and regulations, such as criminal law, administrative law,etc. as supplementary direct protenction. This text points out the basic conception of personal secrets and right of privacy on the basis of analysing the relevant legislative experience of the foreign right of privacy.Combining our country's current legislation,it also points out that the defect of the legal protection of right of privacy of our country and legal protection and proposes perfecting the right and privacy of our country are proposed.
