法律概念与开放系统

法律概念是在人们的生活方式不断更新的过程中,立法者在法律调整中对欲规范事物所具有的各种特征的基础上,根据某种立法意图、规范意旨所规定的最基本的法律思维形式,是对欲规范事物在一定阶段上的兼顾社会心理的理性总结和定位。法律概念不断生成的过程是法律预见性和参与性的过程。作为法律思维的最基本单位,法律概念使法律法规系统成为一个开放的系统。这既是社会伦理、法律发展的需要,也是人类理性认识发展的需要。

Legal Concepts and Open System

Legal concept is the basic legal thinking form that legislators specify according to legislative in- tentions and aim of standardization based on the various characteristics of the things that they intend to standardize in the process of constant updating of people's lives,and the rational summary and orientation for social mentality which they want to take account of the same as they take account of the matters they in- tend to standardize.The process where legal concepts appear continuously is the process of legal prediction and participation.As the minimal unit of legal thinking,legal concept makes legal and regulation system an open system,which is both the demands of the development of social ethics and laws,and the demands of the development of human rational cognition.
