检察机关介入死刑复核程序的制度构建

With the comprehensive retraction of the rights of judicial review of the death penalty to Supreme Court,our judicial review of death penalty procedure needs to be innovated.The intervention of procuratorial organ is of great importance both in the academic field and the judicial practice.Procuratorial organ is supposed to be of dual characters for both the criminal prosecution and legal supervision.For the judicial justice,the respect and protection of the human rights,the procuratorial organ,which is endowed for the right to start the procedure of judicial review of the death penalty,is expected to perform the criminal prosecution and judicial supervision.
