Law and Economics-Based Study of Optimal International Patent System

An analysis is made of the impact of the patent system on international economy, and the serious hinder of the current patent protection system to technological innovation and development capacity in developing countries. A comparative study is conducted on the intellectual property system difference between the developed countries and undeveloped countries in the technical areas, stages of economic and strategic differences in national competition. An empirical study reveals the hindered impact of the current world patent system on technological innovation and economic development in the developing world. Based on the law economic and empirical studies in combination with the current international patent system, an optimal international patent system is presented to balance the economic interests between developed and developing countries in the international patent system.
