关于完善我国商标法的研究

我国商标法的基本框架构筑于改革开放的80年代初期，随着我国市场经济的发展，国际社会对知识产权法律保护的日臻完善，作者认为有必要进一步修改与完善我国的商标法．在研究关贸总协定知识产权协议及参考了大量国外有关商标法规的基础上，作者认为我国的商标法应进行如下几方面的修改与完善：（1）扩大保护客体，增加驰名商标的保护内容；（2）增加查处手段；（3）强化处罚力度；（4）删掉一些法律交叉内容和不可行的规定．

RESEARCH ON IMPROVEMENT OF CURRENT TRADEMARK LAW OF PEOPLE'S REPUBLIC OF CHINA

Chinese 《trademark law》 was framed at turn of the 1980's. With the development of our country market-oriented economy and perfection of international intellective property right protection, it's neassary to amend our country 《trademark law》, which made it perfected. On the basis of study of TRIPS and lots of foreign trademark laws and regulations, we think Chinese trademark law should be amended as follows: (1) expanding protected object, enlarging famous trademark item; (2) enlarging methods of cheeking and penalty; (3) strengthening the penalty degree; (4) deletion some overlapped items and unfeasibility regchtions.
