多重立法模式下的计算机软件知识产权保护

为了适应社交网站迅速发展,对社交小游戏等计算机软件进行良好保护,应当赋予计算机软件综合的知识产权保护。对计算机软件的知识产权保护不应专门立法,而应当以多重立法模式进行保护。具体言之,计算机软件的保护应以著作权的保护为主,以特殊的专利申请程序进行专利法保护,同时符合条件的应依据商业秘密、反不正当竞争相关的法律规范辅助保护。
