我国民法解释方法的理论依据和价值取向——以概念法学为视角

概念法学对大陆法系国家民法理论及民事立法产生了深远的影响。但进入20世纪以后,概念法学受到了来自自由法学运动的如潮批判,同时遭受到英美法国家判例传统的冲击。在我国民法发展的重要历史阶段,有必要重提概念法学的基本原则和精神,从历史的角度正确对待概念法学,并阐明我国民法解释方法的理论依据和价值取向。

Theory Foundation and Value Pursuit of Interpreting Civil Law in China: in the Light of Conception Law Theory

The conception law science had once exerted far-reaching influence to the theory and legislation of civil law in countries of continental law family.However,since 20th century,the conception law science has suffered fierce criticism from the free law movement as well as challenge from the tradition of case law in countries of common law family.It is necessary to repeat the basic principle and spirit of conception law theory with an important of civil law development stage in history,to understand the conception law reasonably in a historical light,so that illustrate theory foundation and value pursuit of interpreting civil law in China.
