| 摘 要： | 我国《合同法》第74条、75条关于债权人撤销权制度，为债权人行使撤销权提供了法律上的依据。但由于没有具体的规定，理论与实践中仍有若干问题有待研究，债权人的撤销权应为形成权，债权人在行使撤销权时应减轻举证责任。

| Abstract: | The article 74 and 75 of the Chinese Contract Law in the legal fraternity provide bases in regulations for the creditor's right of revocation. But for no concrete rules, there are a few subjects still on research in theory and practice. The creditor' s right of revocation should be the right of formation and the creditor should pay attention to some matters when he exerts his right. |
