三峡库区农村土地流转的法律思考

随着三峡工程移民搬迁企业、集镇的逐步建成，区县城市规模的不断扩张，库区农村土地流转悄然兴起并呈加速态势。它不仅抑制了库区农村土地抛荒，而且促进了库区农民向非农产业转移，推动了库区高效生态农业的发展，拓展了移民安置空间．但同时也存在着土地流转形式混乱、无法可依、纠纷时有发生甚至潜伏隐患等问题。克服这些问题的根本之策在于加强农村土地流转的法制建设。

Legal Reflection on the Land Transfer in Rural Three Gorges Area

With the relocation of enterprises, the gradual completion of towns, and the expansion of county city in the Three Gorges area, the land transfer in the countryside appears and increases at a fast speed. This not only prevents the land from wasting in rural area but also helps the farmers transfer to non-agricultural industries, promotes the development of high efficient eco-agriculture, and provides more room for migrants?resettlement. However, meanwhile there exist such problems as the confusing forms of land transfer, no laws to abide by in land transfer, disputes, and some potential problems. The fundamental policy to avoid such problems is to strengthen legal construction about land transfer in the rural areas.
