| 摘 要： | 司法公正和效率是现代司法的灵魂和生命，是人们不倦追求的司法基本价值。司法公正和效率的实现受制于多种因素，牵涉到社会生活的方方面面。但本文认为，司法观念的现代化、司法独立的真正落实、良好的立法状况、高素质的法官、积极的当事人和完善有效的司法监督体系是实现司法公正和效率的决定性因素，并以此为标准针对我国的司法缺陷提出了建议性措施。

| Abstract: | Judicial justice and efficiency are of vital importance. According to the thesis, the modernization of the judicial conception, the real implementation of the absolutely judicial power, the good legislative conditions,the judicial group of high quality , the active party concerned and the perfectly and effectively judicial supervision systems are the crucial factors of carrying out the justice and efficiency of administration of justice. Then the thesis regards them as standards and puts forward some suggestive measures for the defects which limited the real- ization of our native justice and efficiency. |
