| 摘 要： | 探讨刑法司法解释的首要前提应该是廓清有关法律解释内涵的迷雾,然后此基础上引入机制的研究思路。通过对刑法司法解释机制的指导理念以及生成机制和适用机制几个方面的考察,为解决我国目前刑法司法解释中存在的问题提供研究角度上的突破口。
