庭审公开的制度保障与程序控制

以司法公开促进司法公正、以司法公正树立司法公信被认为是提升司法公信力的重要途径。庭审公开作为司法公开的核心内容,理应成为提升司法公信力的着力点。然而,当前的庭审公开实践并未达到其应有价值,在具体操作层面还存在着诸多不足,这需要我们在司法实践中不断地总结经验,在庭审公开原则的基础上,明确案件公开审理的范围,并制定相关技术规范,将庭审公开置于程序控制之下,使其制度化、规范化、标准化。
