浅议我国刑事强制措施中的比例原则

刑事强制措施在打击犯罪、保障刑事诉讼顺利进行方面发挥着重要作用,但与此同时又不可避免地触犯了公民的合法权益。因此,需要在刑事强制措施制度中引入比例原则。比例原则强调采取刑事强制措施时的合理限制,达到手段与目的的必要性与相称性。这不仅有利于防止公权力的滥用,而且对于人权的保障、社会冲突的缓解、社会主义和谐社会的构建具有非常重要的意义。

Establishing the Principle of Proportionality in the China’s Criminal Compulsory Measures

Criminal coercive measures play an important role in protecting the smooth conduct of criminal proceedings,but they inevitably violate the legal rights of citizens.Therefore,the principle of proportionality should be introduced in the criminal coercive measures,which stresses both reasonable restrictions and means and ends of the necessity and proportionality.This has very important significance in preventing the abuse of public power,protection of human rights,social conflict mitigation,building a harmonious socialist society.
