| 摘 要： | 目前,我国有关刑事被害人补偿的立法尚付阙如。国外许多国家的刑事被害人补偿制度在构成条件、补偿类型同补偿金额等方面都有详尽的规定。从对国外刑事被害人补偿制度的规律和特点的分析来看,我国在建构此项制度时,应该在补偿对象上综合考虑身份条件和原因条件,在补偿制度所涉及的犯罪类型方面,更要以暴力犯罪为主。 |

| Abstract: | At present,China's criminal victim compensation is still a blank field.Looking over the overseas na- tional criminal victim compensation system,in the constitution condition,compensation type with the compensate amounts,all has the exhaustive stipulation.Unifies the rule and the characteristic of the overseas law,to con- structing the compensation system of criminal victims and put forward its own vision. |
