| 摘 要： | 注意义务作为犯罪过失的核心要素,是各国刑法学者们所着力研究的一个重大理论问题。中外刑法理论和刑事司法实践对注意义务的概念、内容、根据等方面的认识有很大的差异。通过对注意义务进行比较研究,可以为完善我国刑事立法提供一定的参考作用。

| Abstract: | As the essential element of criminal negligence, obligation of attention has been seriously disputed during the development of penal law in each country. There are some different in basis , content , rule of obligation of attention. Compared with obligation of attention, we can put forwards some suggestions to prompt our criminal law. |
