| 摘 要： | 对我国现行高等教育法律、法规进行分析，可以发现高等教育立法中存在着学生权利严重缺失现象。学生因高等教育性质应享有其本体性权利——学籍权；学生因高等教育关系应享有其契约性权利——获得良好教育权；学生因其高等学校主体性质应享有参与学校民主管理权；学生因违法行为受到处分时应获得司法审查的最高救济。

| Abstract: | An analysis of current higher education laws and rules in China shows that there exists serious absence of student＇ s rights in higher education legislation. In fact, according the essence of higher education, students should have their subjectivity right- registration right;according to their relationship with higher education, students should have their contract right - right of getting good education; according to the subjectivity of colleges or universities, students should have democratic management right;students should also obtain the highest juridical remedy if they are punished because of violation of laws. |
