论遗传资源的法律保护

遗传资源作为生物多样性的重要组成部分，是实现经济社会可持续发展的重要战略资源。当前。世界各国关于知识产权的保护模式主要有商业秘密保护、地理标志保护、专利制度保护等几种。我国新修订的《专利法》首次加入了遗传资源保护的条款，但有其局限性。为了更好地保护我国独特的遗传资源，我国一方面应该构建保护遗传资源的专门立法．另一方面应加强知识产权制度的完善。

On Legal Protection of Genetic Resources

Genetic resource is an important part of the biological diversity and the significant strategic resource to realize the sustainable development of society. At present, the models of intellectual property rights protection in the world are mainly： protection of business secrets, protection of geographical indications, protection of patents and so on. Our new Patent Law first joined the clause of the genetic resource protection, but there are still some limitations. In order to protect our unique genetic resource better, we should establish the special legislation of genetic resource, and strengthen the system of intellectual property rights.
