质疑“证据之王”

证据证明力的大小是刑事诉讼中一个最敏感的话题。通过对几种所谓“证据之王”的比较分析,不难看出任何证据的证明力都是相对的,片面强调和相信所谓证据之王必将犯形而上学的错误,并违背“以事实为依据,以法律为准绳”的法制总原则,在司法实践中会造成不可估量的损失。
