| 摘 要： | 抵押权制度起源于古罗马法,其经历了一个漫长的发展过程,而终于奠定了今天的“担保之王”的地位。但随着现代经济的发展,抵押权制度也在不断遭受社会实践的挑战。如何使传统的抵押权制度适应现代化的发展趋势,以满足社会生活的需要,本文围绕抵押权的价值目标而提出相应设计。
