| 摘 要： | 表见代理的认定一直困扰着我国法学界和司法界。从基本性质、构成要件、法律关系、举证责任等方面对表见代理和狭义无权代理进行了分析和比较，对表见代理的法律概念和制度进行了研究，并以无权代理和狭义无权代理为参照，揭示表见代理的核心概念和基本性质，从而分析其构成要件和法律关系，为法律实践提供理论依据。

| Abstract: | The law science circles and the judicial circles are always puzzled by the identification of the list agency. This paper makes comparison and analysis of the list agency and the narrow ex-agency from the basic nature, important components, legal relations, burden of proof and other aspects, researches on the legal conception and system of the list agency, and taking the ex-agency and the narrow e-agency as the references, reveals the core conceptions and basic features of the list agency, and analyzes on its important components and the legal relations for providing the theoretical foundation for the legal practice. |
