| 摘 要： | 疑案从无属于无罪推定原则的主要内容之一，我国刑事诉讼法已明确规定了疑案从无的司法原则，实践中司法机关根据这一原则对一些疑案作了无罪处理，效果良好。但是，还经常发生对某一案件是否属于疑案的争议，理论上对疑案的界定亦不明确。

The Innocent Presumption of the Doubtful Case and Its Confirmation |

| Abstract: | That the doubtful case subordinates innocence is one of the main contents of the principle of innocent presumption. The criminal law in China has already firmly stipulated this judicial principle, with which the judicial authority in China has successfully dealt with some doubtful cases with good result. However, the dispute of confirmation of such cases often occurs and their theoretical definition is not definite yet. |
