| 摘 要： | 文章分析了在处理环境纠纷时民事诉讼和行政诉讼中存在的问题，得出制约我国环境纠纷处理的主要因素为我国有关环境方面的立法不完善。故必须建立和完善相关的法律制度和环境权实现机制，在环境诉讼司法救济上为保护当事人合法权益树立最终屏障。

| Abstract: | The paper analyzes some problems in civil and administrative litigations in dealing with environmental disputes, reaching the conclusion that the major factor influencing the handling of the disputes in China is the imperfect related environmental legislation. Therefore, related legal systems and environmental fight realizing system must be constructed and perfected to protect people＇s legitimate fights of environmental litigation, the judicial remedy. |
