高校信息公开法律制度的理论及现实适用

高校信息公开法律制度不仅源自于公民的知情权，也源自于教育的公共性和社会治理。教育的公共性是高校信息公开的逻辑基础，公民的知情权是高校信息公开的权利本源，社会治理是高校信息公开的价值诉求。该制度的建立，确保了公众知情权的落实，推动了公众参与高校事务，增强了社会对高校的监督。然而在现实适用中存在着高校信息公开的主体、对象、范围、监督与救济机制不完善，高校信息公开的组织机构和实施机构依然缺位的问题。

Theory of the Legal System of University Information Disclosure and Reality Applies

The legal system of the university information disclosure not only derived from the citizen＇s right to know and also stem from the educational publicity and social governance. Educational publicity is the logical basis for the information disclosure, the citizen~ right to know is the rights of access to information source, social govern- ance is the value pursuit of the university information disclosure. University information disclosure will contribute to the realization of the citizen＇s right to know, promote public participation in university affairs, strengthen the social supervision of universities. In reality applier, however, there are many problems as following： the subject, object, scope, supervision and relief system of university information disclosure are not perfect, the organization and imple- mentation mechanism are not still established.
