摘    要:当前中国就业领域存在严重的就业歧视,特别是妇女就业歧视,这不仅破坏了宪法所规定的平等权原则,而且严重损害公民的平等就业机会。随着市场经济的发展,人们平等意识和权利意识的提高,有关就业歧视争议案件将越来越多,我国应结合国际上反就业歧视的举措,构建适合中国国情的反就业歧视法律制度,在进一步完善现有法律体系的同时,通过专门立法和引入平等权行为政策等措施,以更充分地保证我国公民平等的就业机会和权利。

Abstract:In contemporary China, employment discrimination phenomenon exist widely, especially the discrimination to women's employment, which not only runs counter to the equal power principle which was stipulated by the constitution, but also brings great harm to the citizen's equal employment opportunity. As the development of market economy and the enhancement of people's equality and rights consciousness, more and more dispute cases related with employment discrimination arise. We shall borrow the experience of foreign countries' legislating spirits and contents to construct a more suitable counter-employment discrimination system.
